Shipping, Delivery & Jurisdiction Policy

Virgin Islands Exotics, LLC (“VI Exotics,” “we,” “us,” or “our”) is committed to responsible fulfillment and to shipping or delivering products only where we determine that the applicable product and method of fulfillment are permitted under applicable requirements and VI Exotics compliance standards.

Product availability, shipping eligibility, and delivery options may vary based on the product, destination, applicable law, regulatory requirements, carrier requirements, and other compliance considerations.

SHIPPING AVAILABILITY

VI Exotics may ship eligible products to destinations within the United States where we determine that shipment of the applicable product is permitted and consistent with applicable federal, state, territorial, and local requirements.

Product classification and shipment eligibility are separate determinations. A product's classification under federal law does not independently establish that the product may lawfully be sold, shipped, delivered, possessed, or otherwise made available in every jurisdiction.

Where relevant, VI Exotics evaluates federal product classification under applicable federal law, including 7 U.S.C. § 1639o and 21 U.S.C. § 802(16), together with other applicable requirements, in each case as amended and in effect at the relevant time.

VI Exotics does not ship every product to every jurisdiction.

Availability in one jurisdiction does not mean that the same product is available or eligible for shipment to another jurisdiction.

Shipping eligibility is determined at or before fulfillment and may be reconsidered if applicable requirements or circumstances change.

DESTINATION & JURISDICTION REVIEW

VI Exotics may evaluate a shipment based on factors including:

  • Product classification and composition

  • Destination

  • Applicable federal law

  • State, territorial, and local requirements

  • Laboratory documentation

  • Age or identity requirements

  • Licensing or permitting requirements

  • Carrier requirements

  • Current regulatory or enforcement conditions

  • VI Exotics compliance standards

VI Exotics may maintain internal jurisdiction restrictions that are not publicly displayed.

Those restrictions may be more conservative than the minimum requirements of a particular jurisdiction.

VI Exotics reserves the right to restrict, suspend, or decline shipment to any state, territory, locality, ZIP code, address, or other destination when reasonably necessary for legal, regulatory, carrier, compliance, fraud-prevention, safety, or business reasons.

INTERSTATE TRANSPORTATION & DESTINATION ELIGIBILITY

Applicable federal law may separately address transportation or shipment through a state or Tribal territory.

Any protection applicable to transportation through a jurisdiction does not, by itself, establish that a product may lawfully be sold, delivered, distributed, possessed, or otherwise made available at the ultimate destination.

VI Exotics therefore evaluates destination eligibility independently from any legal provision that may apply solely to transportation through another jurisdiction.

Nothing in this policy alters the legal classification of a product or authorizes any transaction, shipment, delivery, possession, transportation, or other activity otherwise prohibited by applicable law.

CHANGES IN LAW

Cannabis, cannabinoid, product-classification, shipping, and product-availability laws and regulations may change.

References in this policy to statutes, regulations, classifications, concentration standards, or other legal requirements mean those provisions as amended and in effect at the relevant time.

A destination or product that is eligible for shipment at one time may subsequently become restricted or unavailable.

VI Exotics may modify shipping eligibility or fulfillment procedures without prior notice when reasonably necessary to respond to changes in applicable law, regulation, regulatory guidance, enforcement conditions, carrier requirements, or VI Exotics compliance standards.

If applicable requirements change after an order is submitted but before fulfillment, VI Exotics may delay, modify, decline, or cancel the affected fulfillment as reasonably necessary.

ORDER REVIEW & ACCEPTANCE

Submitting an order or request, receiving product or availability information, receiving a private purchasing opportunity or link, or submitting payment does not by itself guarantee acceptance, fulfillment, or shipment.

Orders and requests may remain subject to compliance review before fulfillment.

VI Exotics may request additional information or documentation when reasonably necessary to evaluate eligibility or fulfillment.

An order may be delayed, declined, or cancelled if VI Exotics determines that the product or requested method of fulfillment cannot or should not be provided to the requested destination.

If VI Exotics cancels an order before fulfillment because the applicable product or destination is ineligible, amounts paid for products that will not be fulfilled will be handled in accordance with our Returns, Refunds & Cancellations Policy and applicable law.

CUSTOMER INFORMATION & RESPONSIBILITY

Customers must provide complete and accurate information concerning their age, identity, shipping or delivery destination, and other information reasonably requested for fulfillment or compliance purposes.

Customers are responsible for complying with laws applicable to their purchase, receipt, possession, transportation, and use of VI Exotics products.

Customers may not knowingly request shipment to one jurisdiction for the purpose of forwarding, transporting, transferring, or redirecting a product into another jurisdiction where that product is prohibited.

VI Exotics does not authorize the use of its products, services, shipping methods, or fulfillment processes to circumvent geographic or legal restrictions.

VI Exotics may refuse or cancel a transaction when we reasonably believe information provided is inaccurate, incomplete, misleading, or intended to circumvent applicable restrictions.

21+ SHIPMENTS

VI Exotics products are intended exclusively for adults 21 years of age or older.

Age or identity verification may be required before an order is approved, fulfilled, shipped, delivered, picked up, or otherwise released.

A transaction or delivery may be refused when applicable age or identity requirements cannot be satisfactorily completed.

SHIPPING CARRIERS

VI Exotics may select available carriers, shipping services, and fulfillment methods based on destination, product eligibility, service availability, applicable requirements, carrier requirements, and business considerations.

Carrier policies and acceptance requirements are separate from VI Exotics product-classification and destination-eligibility determinations.

A carrier's acceptance of a shipment or availability of service to a destination does not constitute a determination or representation by VI Exotics that a particular product is lawful for every person or purpose within that destination.

VI Exotics may change carriers or shipping methods when reasonably appropriate.

Customers may not request a particular carrier or shipping method for the purpose of avoiding an applicable restriction or compliance requirement.

SHIPPING DOCUMENTATION & TRACEABILITY

Where appropriate, VI Exotics shipments may include or provide access to batch- or lot-specific product information, laboratory documentation, Certificates of Analysis (“COAs”), QR codes, compliance information, or other documentation associated with the products being shipped.

Such documentation supports product identification, transparency, traceability, and compliance review but does not independently guarantee legal status in every jurisdiction or prevent inspection or review by carriers or governmental authorities.

Customers should retain original product packaging and associated documentation where appropriate.

PROCESSING & ESTIMATED DELIVERY

Processing and transit times may vary based on order volume, destination, carrier operations, weather, holidays, regulatory considerations, compliance review, and other circumstances.

Any processing, delivery, or transit estimate provided by VI Exotics or a carrier is an estimate and not a guarantee unless expressly stated otherwise.

VI Exotics is not responsible for delays caused by circumstances outside our reasonable control, subject to applicable law.

TRACKING

When tracking is available, tracking information may be provided after a shipment has been processed or accepted by the applicable carrier.

Tracking information is generated and updated by the carrier and may not always reflect the shipment's location or status in real time.

A tracking update or carrier status does not modify the customer's obligations under this policy.

ACCURATE SHIPPING INFORMATION

Customers are responsible for providing a complete and accurate shipping or delivery address.

VI Exotics is not responsible for delays, failed deliveries, returns, or losses resulting from inaccurate, incomplete, or outdated information supplied by the customer, except to the extent otherwise required by applicable law.

Additional costs resulting from an incorrect address, refused shipment, unsuccessful delivery, or requested reshipment may be the responsibility of the customer where permitted by applicable law.

LOST DAMAGED OR MISSING SHIPMENTS

Customers should contact VI Exotics promptly if a shipment appears to have been lost, arrives materially damaged, or contains an incorrect or missing item.

VI Exotics may require photographs, original packaging, tracking information, product information, or other documentation reasonably necessary to investigate a claim.

Resolution of eligible claims will be handled in accordance with our Returns, Refunds & Cancellations Policy, applicable carrier procedures, and applicable law.

LOCAL DELIVERY & PICKUP

Where permitted and available, VI Exotics may offer local delivery or pickup separately from carrier-based shipping.

Local delivery or pickup availability depends on the applicable product, service area, applicable law, regulatory requirements, age requirements, and current VI Exotics operations.

The existence of a delivery or pickup option does not guarantee that every product is eligible for that method of fulfillment.

Government-issued identification or other age verification may be required before a product is released.

VI Exotics may refuse release when applicable eligibility, identification, or compliance requirements cannot be satisfactorily completed.

U.S. VIRGIN ISLANDS

Product availability for local sale, delivery, pickup, distribution, or other fulfillment within the U.S. Virgin Islands is determined separately from eligibility for shipment to other jurisdictions.

Local fulfillment is subject to applicable Virgin Islands law and regulatory requirements in effect at the time of the transaction and fulfillment.

Availability of a product for shipment elsewhere should not be interpreted as establishing that the same product is available or eligible for local fulfillment within the Virgin Islands.

REFUSED RETURNED OR UNDELIVERABLE SHIPMENTS

A shipment may be refused, returned, delayed, or considered undeliverable for reasons including an inaccurate or incomplete address, inability to complete required age or identity verification, carrier restrictions, recipient refusal, regulatory intervention, or other delivery-related circumstances.

Refunds, reshipments, replacements, and additional shipping charges associated with such shipments will be determined under our Returns, Refunds & Cancellations Policy, applicable carrier procedures, and applicable law.

INSPECTION & REGULATORY REVIEW

Products and shipments may be inspected, questioned, delayed, detained, returned, or otherwise reviewed by carriers, law-enforcement authorities, governmental agencies, or other authorized parties.

Product packaging, laboratory documentation, COAs, QR codes, compliance labels, or other documentation may assist with product identification and transparency but do not guarantee that a shipment will not be inspected, delayed, detained, or questioned.

VI Exotics may cooperate with lawful requests from carriers, governmental agencies, or other authorities as required or appropriate under applicable law.

NO GUARANTEE OF DESTINATION ELIGIBILITY

Product information displayed or communicated by VI Exotics, access to viexotics.com, receipt of a private link, carrier service availability, laboratory documentation, previous shipment to a jurisdiction, or classification under federal law does not guarantee that a future shipment of the same or another product will be accepted or permitted.

Eligibility may be evaluated separately for each product, transaction, destination, customer, and method of fulfillment based on the circumstances and legal requirements applicable at that time.

COMPLIANCE TAKES PRIORITY

VI Exotics reserves the right to delay, restrict, refuse, suspend, modify, or cancel fulfillment when reasonably necessary to address a legal, regulatory, carrier, safety, fraud-prevention, or compliance concern.

VI Exotics may impose additional documentation, verification, shipping, delivery, or fulfillment requirements when reasonably necessary for compliance purposes.

Compliance takes priority over completing a transaction.

POLICY UPDATES

VI Exotics may modify this policy to reflect changes in applicable law, regulations, regulatory guidance, shipping availability, carrier requirements, delivery practices, service areas, compliance standards, or business operations.
